I would like to thank the above for their sound reasoning. It's not a question that it's for some private sealed collection to sell in the future, it's about giving a gift that is unsealed and thus giving a bad impression. I would have no problem with the store if in their description they said the game was unsealed but they didn't so they are misleading their customers. If they had I wouldn't of brought it and there wouldn't be a problem.

Oh give over.

As far as shopto service I am happy to hear they have happy customers that comes to the stores defense, however that is not my case. I am not happy when I call up and the help I get is being told "they are all unsealed because we got them that way from EA" ( I suppose he meant EA distributor)

Because you dont like hearing the truth?

a: They don't even see the stock they have in the store it's an automated warehouse (see video at shopto website) so how could the guy know!

b: I haven't seen them unsealed anywhere else.

Clearly, the guy is lying because he didn't go down to the warehouse and look at all the copies he has and if by any chance the EA distributor said they are all unsealed they should of stated this on the website since they had the information beforehand.

So where have you seen them then? How do you know he is lying?

It is simply a question of good customer service, there is no need for people to get too excited about this. I will appraise the store depending on the service I receive both on their website and when calling that is all.

You've received both, from what I can see.

All I can suggest is you dont buy from ShopTo in the future. Of course, please feel free to repost when your experience is replicated from any other retailer :P

Bit of a fuss over nothing... OK, it was a gift. Still, a mountain arises from your molehill of a problem.

Badmouthing the retailer over it seems a tad extreme.

I'm not badmouthing anyone I simply informing people of the level of service I received from a particular store, it may be of interest to some and if it isn't simply don't go into the thread.

Not sure if anyone has seen shopto starbuys but I just received a copy of Dante Inferno and it was unsealed didn't expect this from them. However, I should of taken notice of the people at neogaf who have said that their service has gone down the drain in many ways. You'd expect this from play.com with their mispicks but not shopto what shoddy service sending out returns! :P:)

That sounds like badmouthing to me.

You're really on a hiding to nothing trying to elicit sympathy round here. I'd give it up as a bad job, if I were you.

Secondly you don't see anything because all I'm asking for is that if a store wishes to sell unsealed software to specify it in the description. I don't think that is being unreasonable.

I've never understood this sealed mentality. If the disk is mint, and the instructions are mint, and the case is mint, it doesn't matter unless you're an OCD nutcase. And as some have mentioned, not all games come sealed. EA ones do, but neither here nor there really.

They are under no obligation to tell you whether they're sealed or not.

Please try and read my posts, I don't mind if they wish to sell unsealed software but I do think I have a right to know it in the product description especially if I am buying it as a gift.

It is a fact their is a thread on neogaf reflecting as in ntsc uk (which I posted earlier). I'm not trying to elicit anything, not sure about you! Do you work for shopto by the way, because you very insistant.

Unless it said "sealed" in the product description, they've done nothing wrong. Ebay and a few places state whether a product is sealed so you get that certainty but you have to pay whatever price ebay or whoever charges for this certainty. Lots of places sell unsealed games and lots of places don't state whether they are sealed or not. If you want to make sure, call or email them before you order.

I understand it - I even like getting a shiny new sealed game, but the reality of it is, in the vast majority of cases unless you are ordering online you WILL get an unsealed game. The major UK games retailer frequently provides unsealed games because they put the discs behind the counter - the exceptions are those games that are brand new and in the glass display case.

If the person you are giving this to is a frequent gamer they should be aware of the above, too.

You have a valid point, but you've also opted to bring in other "problems" that people have had (like FFXIII not arriving on time, or their text messages not working on one occasion) in order to paint a wider 'bad' picture of an online retailer that is for the most part very highly regarded. Of course people will end up defending them.

You don't know the guy was lying, either. Perhaps he has been lied to - you don't know. He may well have given you all of the information he had; whether it's the truth or not is anybody's guess, he may not even know himself. There may have been a note on the system, they may have had other complaints etc. I very much doubt it's pre-owned, though.

I'd also really like to know where you buy your games if they never have unsealed games! I usually find some supermarkets will have sealed copies, again behind the desk, but they're able to do it because of limited stock. Game certainly only have a few that will be sealed, ditto Gamestation. HMV I'm not sure on these days. Argos are probably sealed, but again, limited stock, and you wouldn't really be able to 'see' their selection.

You make valid points, I tend to buy my games from Amazon.co.uk and they have always been sealed. Not just the questionable information it was the attitude I received from the person that annoyed, and generally from the threads I have read talking about shopto this has been the case.

1) Why does it give a bad impression? As others have said, are people receiving gifts that shallow/fussy? If you bought something else in a box, say a kettle, would it matter if it had a bit of sellotape over the top? Would it shite.

2) Who else gives this sort of information, on wether something is sealed or not? Its just not done practice by any game retailer, and nor should it be. This isnt the rllmuk trading forum or ebay "R@R3 STILL SEAL3D!!!!11one". Which is done to differentiate fro second hand goods. No such problems from retailers, because they're actual companies following the law (in theory)

4) Have you considered that It wouldnt matter where you bought it from online or instore, because they all came from EA like that? Unsealed.

1) This answer has already been answered by somebody post in this thread, please try and read through the thread carefully. If you brought a mobile you would'nt mind if the seal was broken even though it generally says on the seal do not accept if the seal is broken. It's stupid to argue over this just try and be tolerant of other peoples opinion. I am quite happy that you are willing to accept unsealed game "Good for you".

2) There are sites that do I think one of them is the thegamecollection, and Amazon resellers otherwise if it's always been my experience that the software has been sealed.

3) The product is not as described and wouldn't be considered so under the current law of contract in the UK.

4) I have been to HMV this morning and brought a sealed copy, so no they are not all unsealed.

I hope so, the alternative is rather depressing.

I don't think enough people actually give a fuck about this problem to warrant the companies advertising whether a game is sealed or not. Thanks for the thread though 7/10.

I think if it was information that influences a buying decision some might find it helpful. Perhaps there should be a forum vote.

I respect the fact that some people don't mind their game to be unsealed, fair enough but I think the other point of view should also be respected. However it's upsetting because the game was being purchased as a gift and I personally don't like giving presents that look like they have been opened. It gives the impression of not being a gift but of something your trying to discard.

The guy at shopto was nasty on the phone there is no need for that and I would like to be refunded the postage which they are unwilling to do.
