Seven pages over a bit of plastic wrapping. :)

Not one of our finer moments I fear.

It's not about plastic wrapping it's about your rights as a consumer, but you can always see it that way.

Maybe he "should of" "brought" the game from hmv in the first place. :P

What rights? You bought a game. It was new. What's the problem?

3) The product is not as described and wouldn't be considered so under the current law of contract in the UK.

4) I have been to HMV this morning and brought a sealed copy, so no they are not all unsealed.

Give your local trading standards a ring. Go on, pick up the phone, and tell them what you've told us in this thread. They'll fucking laugh down the phone at you.

Has it occured that HMV may of got their copies from a different supplier, or vice versa? Who's to say Shopto has even bought them from the same part of EA? It's possible!

I really can't see your point at all - shopto are the most consistently reliable games shop on the internet and the 2 occasions I've had to deal with them they were pretty decent - once for the Halo 3 SE which got bashed to hell when it shipped - they took it back - paid for postage and swapped the box and disk that was damaged over for a nice shiny new one - all well packaged. The other was when my copy of Bully on the 360 failed to appear - I waited 3 days - filled in a form and had a new copy through about a day later.

I usually don't go anywhere else for my games now because I know I'll get it at least a day early (hello god of war 3) and it'll be one of - if not the - cheapest price available.

It would have been 1 more but I pressed view results by mistake. Interested in the consumer rights angle in all of this, I'm no lawyer but be keen to know how our rights are affected here?

I think the cellophane seals should be banned anyway. Pointless and wasteful, bad for the environment. etc.

I've been given second-hand games as a gift before, never mind unsealed. It didn't 'leave a bad impression' on me haha. It's just plastic, it doesn't have any intrinsic value.

Why exactly?

Don't really care where they got them from just would like to know whether it sealed before I buy, is it too much to ask to add it to the product description. I can't fathom why an additional piece of information would cause so much discomfort!

Actually I bought a game over Xbox Live Marketplace the other day and you know what? No shrink wrap, damn you to hell Micro$oft!!!

When i worked at GS every Konami UK game came unsealed, direct from supplier. Metal Gear Solid 3 and the earlier Pro Evos spring to mind.

Wouldn't boast about it!

Just because it's not wrapped in cellophane, that doesn't make it second-hand. The description does match the product.

Besides, it would be a very strange thing to add for the benefit of one or two odd people. Sites don't even say if something 'comes in one of those horrible blister packs designed to defend against nuclear explosions'.

Or indeed 'box has a bit of sellotape on the lid'.

You're buying the product, rather than the packaging. Frankly I could do without gamecases, but that's unusual, and is just because I am jumping between France and the UK a lot, so my games go straight into a disc wallet and I have nowhere to put the damn things.

shop "Can you tell me if the game you might be shipping us in three months time comes wrapped or not?"

distributor "... Eh? How should I know? Why does it matter?"

I suppose it's the principle that if something is new it should be new and if it's used it should state it and be cheaper for it.

If you buy a flat screen TV and it's been used I don't think you would be happy even if it didn't have finger prints on it. I don't think I am being unreasonable here.

Unsealed doesn't mean used, though. It just means it's unsealed, which could mean that A.) someone has unsealed it, but not necessarily used it, B.) that it came unsealed in the first place, or C.) that it's been used and being falsely sold as new.

But even getting a sealed game doesn't mean it hasn't been used, as it could always be resealed. Unless it's an actual manufacturers' seal.

They should probably mention that it is unsealed, since some people care about that. It's not something that bothers me, but I can understand your frustration.

Not much else to say, is there? Make the suggestion to ShopTo that they mention whether a game is sealed or not, and then shop somewhere else. *shrug*
