These are all console games thus I suppose must conform to some standard set by sony for the packaging so I doubt they sell them without the sony seal without a reason behind it.

Some of them do. Konami, for instance, don't seem to ever sell their games sealed. I bought MGS4 on release day from Amazon, and it came without shrinkwrap. It was brand spanking new, that's just how it came.

It happens.

There were finger prints (in, out and on the disc) when I opened the game, I didn't pull the game disc to check if it was scratched because I wasn't going to accept it like that!

You could have mentioned this before! :lol:

I'm struggling to understand why this thread wasn't blasted into the void.

Did anybody mention that HMV don't have the games in wrapping ? OMG they like keep the discs & manual behind the counter and the grubby till person actually TOUCHES the disc when they put it into the box.

I for one will not be using them again.

A few months ago, I argued (with Fugu, I think), that the GAME policy of letting employees play a game in the staff-room on their break, then selling that game as new was wrong. I said they should sell it as used, like the way stores sell 'display copies' a bit cheaper. I said they should do this even though, by and large, there's no way to tell that the game has been used.

My reasoning was that a new game should be unused, and a used game should be sold as much. If game stores kept one copy of a game for store use, then sold it at a slightly cheaper price, it might reassure people (me being the most important of people, obviously) that their 'new' copy of the game was definitely unused, even if it was unsealed.

After reading sweet angel's comments in this thread though, I'd like to change my official stance. He's such a nutball that I now no longer give a damn.

It's really welcoming to be insulted for just stating an opinion. If someone offers a different opinion they are insulted humiliated but it's all just a bit of fun right! Hardly any of the abusive comments have actually read this thread properly and people seem to miss the point that I was complaining about:

a. The item was for a gift.

b. I received attitude over the phone from the customer service guy.

c. I'm within my rights to state an opinion without being insulted for it.

It really surprises me the attitudes I have received on this forum, if you don't wish to vote on this subject and think it's a waste of time then don't read the thread and don't vote nobody is forcing anyone to do anything here!

It is clear that the poll shows that to some people it does matter what state an item is in, and I think the forum should try and be tolerant of other views. At least I think that is what a forum is for, people to discuss what they wish in a civilised manner. If anyone thinks this subject is below them then stay out of the thread and let it die! Why allow it to live by posting smart little comments like kids.

If you don't agree I respect that but don't take this to a personal terrain by being abusive.

To those who have posted their views clearly I am grateful to them and to those who have posted abusive comments, I have nothing to say!

Sorry I didn't have time to come up with a funny pun. I was too busy fretting about whether the book I ordered wil be shrinkwrapped or not. :)

I bet people also want to be able to return their un-shrink wrapped items/games for a full refund if they change their mind - even if it has never been played, and all that was done was that it was unwrapped ("but I didn't realise it was the <x> version, I need the <y>!"). The reseller then either has to sell it as used and lose money, or they try and sell it as new. It's not really fair on the retailer to be in such a position.

Indeed, the likes of CEX don't even accept shrink-wrapped games as trade-ins in case they've been nicked from somewhere or something daft like that (they made me unwrap the Modern Warfare 2 I bought from Makro for £20 to make a profit on - I used it for good, I promise, and bought a text book)!

The person you bought the game for isn't going to care if it's sealed, which was your first assertion (you bought it as a gift and it's unsealed! The recipient will be annoyed!). You've only introduced the fact that there were fingerprints on the disc and that the Shopto guy was rude recently, so to start saying now that you're being needlessly attacked by rllmuk'ers when all you're trying to do is inform us that Shopto are rude and may handle the merchandise is disingenuous. For ages you were throwing a fit because the game was unsealed. That's all you cared about. Then you started talking about consumer rights, until it was pointed out that 'new' does not necessarily mean 'sealed' and there's nothing in the sale of goods act that specifies a company must (or even should) state whether their product is sealed or unsealed. Now you've introduced this 'Shopto are rude' motif and seem to be trying to hang your argument from it.

And you are indeed entitled to your opinion, as is everyone. Mine is that you're taking this sealed/unsealed thing far too seriously and that rather than back down from an Internet argument (which, lest we forget, are famously unwinnable) are trying to dig your way out of this hole by changing the goalposts. I couldn't be bothered to say that, so I called you a nutball instead. And after all, what does it matter if I call you a nutball? We're never going to meet - I'm not even a real person to you, I'm just a fake name on a screen, and a bunch of words. Don't get insulted by it. It doesn't matter. Doesn't this imply all games they send out are sealed?

Anyway, they've always been good to me, early delivery, only had one game robbed in the post, they sorted me out with a new copy no problems. Only had one unsealed game sent by them, but it was cheap so if it was a return I didn't much care.

I couldn't care less about the seal if a game is new but if it's secondhand, then sell at a secondhand price.

Don't know if I believe that a lot of companies are not sealing games nowadays (360/PS3 I mean). I've never seen any, which ones recently out of interest, Morrius?

Hmm....well discovered. Thats BS if they're already sending them out like that.

That said, they often sell brand new games at prices WAY BELOW the cunts at Game, CEX, Gamestation and BB sell em for (sorry...i mean the price they sell second-hand games for...at least for the first week).

But yeah AFAIK they need to advertise if they are second hand or unsealed for that policy to be valid.

It also implies that unopened games can't be returned and, consequently, sent out and sold as new. So surely these unsealed ones can't be from previous customers.

What does unopened mean? Does it imply sealed or for the case to be closed!

A lot shops state this but it doesn't mean it's enforced but the store. Furthermore, since people are arguing here that sealed does not mean it has been used. Remember it is your right to have 7 days to return item under the law (bought from the internet), so there isn't much the store can do as you have a right to do so.

No one is backing out of anything here, I have tried to answer everybody comments but prefer to try and ignore those that don't add anything to the discussions. However, I don't feel a need to insult someone that I do not know just because there is a sense of anonymity when posting in a forum. I didn't add the extra information in the opening post because the post was originally in the bargains forum thus I felt it unnecessary. If your opinion did an impact on my life I assure you I would not continue posting.

Since the thread was moved to discussion I was willing to discuss it as I thought that is was what people wanted when it was pointed out by some and moved by a moderator. Your entitle to think I'm taking sealed/unsealed to seriously but I simply disagree, because it was intended for a birthday present. That is not to say that I don't respect your opinion even if I do not know who you are.
